Niniejsza praca opisuje instytucję tymczasowego aresztowania jako środka ostatecznego (ultima ratio) w polskim porządku prawnym.Tymczasowe aresztowanie nie stanowi kary, lecz środek służący do zabezpieczenia prawidłowego toku postępowania karnego. Ze względu na ciężkie i często nieodwracalne negatywne skutki tego środka, prawo międzynarodowe wymaga, aby stosowanie aresztu tymczasowego stanowiło raczej wyjątek aniżeli regułę. Tymczasowe aresztowanie stosowane być powinno wyłącznie w przypadku, gdy istnieje duże prawdopodobieństwo popełnienia przestępstwa, w celu zabezpieczenia prawidłowego toku postępowania karnego, wyjątkowo by zapobiec popełnieniu nowego ciężkiego przestępstwa, wtedy gdy jest to niezbędne i zgodne z zasadą proporcjonalności. Oznacza to, że tymczasowe aresztowanie nie jest uzasadnione, gdy cele powyższe można osiągnąć za pomocą innych środków, mniej inwazyjnych. Według Europejskiego Trybunału Praw Człowieka, Polska należy do tych krajów, które nadużywają detencyjnego środka zapobiegawczego, który to problem stanowi wyzwanie dla polskiego ustawodawcy oraz polskich sądów. Duża nowelizacja kodeksu postępowania karnego z września 2013 r, która wejdzie w życie z dniem 1 lipca 2015 r., dąży do usprawnienia i przyspieszenia postępowania karnego. W konsekwencji doprowadzić może to do skrócenia ogólnego czasu stosowania tymczasowego aresztowania. Ustawodawca zadbał również o wzmocnienie gwarancji proceduralnych zgodnie ze standardem prawa do rzetelnego procesu karnego, o którym mowa w art. 6 EKPCz, a ponadto ograniczył podstawy stosowania tymczasowego aresztowania oraz udoskonalił procedury stosowania wspomnianego środka. Mając na uwadze nową treść przepisów Kodeksu postępowania karnego oraz zmian, jakie nastąpiły w procesie stosowania przedmiotowego środka w ostatnich latach można stwierdzić, że praktyka stosowania instytucji tymczasowego aresztowania w Polsce zmierza w kierunku właściwym. Istnieje nadzieja, że standard opisany w art. 5 EKPCz zostanie w pełni implementowany do polskiego porządku prawnego.
Pre-trial detention is not a sanction, but a measue to safeguard a criminal procedure. Because of its severe and often irreversible negative effects, international law requires that pre-trial detention should be the exception rather than the rule. Pre-trial detention is only legitimate where there is a high probability of the person having committed the offence, to ensure proper conduct of proceedings, exceptionally to prevent from committing another offence, where detention is necessary and proportionate. This means that pre-trial detention is not legitimate where these objectives can be achieved through other, less intrusive measures. According to the European Court of Human rights, Poland belongs to those countries that abuse the preventive measure of detention, which problem pose a challenge for the Polish legislator and Polish courts. The big amendments to the Code of Criminal Procedure from September 2013, which enter into force on 1 July 2015, aim to streamline and speed up proceedings. In consequence, it may lead to eliminate the problem of too long periods of pre-trial custody. The legislator did take care to strengthen procedural safeguards comprised in the standard of right to fair criminal trial provided for in Art. 6 ECHR and moreover limited the grounds for application of temporary detention and civilized the procedure of applying said measure. Given the new content of the provisions of the Code of Criminal Procedure and the changes that have occurred in the application of this measure in recent years we can say that the practice of using the institution of pre-trial detention in Poland is moving in a right direction. There is a hope the Polish law will implement the standard described in Art. 5 ECHR better than before.
