abstrakt w j. polskim: | Celem pracy magisterskiej zatytułowanej: „Konstytucyjność ograniczeń praw właściciela służących ochronie praw lokatorów” jest próba wykazania tezy, że na gruncie obowiązujących przepisów ochrona praw lokatorów jest zbyt szeroko określona, przez co narusza istotę prawa własności, a jej zakres budzi wątpliwości w kontekście konstytucyjnej zasady proporcjonalności. Konstrukcja pracy jest następująca: w rozdziale pierwszym przedstawiono czynniki, jakie miały wpływ na ukształtowanie się idei ochrony praw lokatorów, a także dokonano zwięzłej charakterystyki najważniejszych źródeł prawa lokatorskiego z okresu Międzywojnia i Polski Ludowej. Ponadto, wspomniano o sytuacji mieszkaniowej w krajach niedotkniętych komunizmem. W rozdziale trzecim, dla kompletności wywodu, przywołano przepisy szczególne odnoszące się do stosunku najmu. Następnie dokonano szczegółowej analizy porównawczej pozycji prawnej wynajmującego i najemcy w oparciu o obowiązujące przepisy. Ponadto, dokonano analizy ustawy o ochronie praw lokatorów, mieszkaniowym zasobie gminy i o zmianie kodeksu cywilnego pod kątem dyrektyw składających się na treść konstytucyjnej zasady proporcjonalności, z uwzględnieniem orzecznictwa Trybunału Konstytucyjnego. W toku wywodu stwierdzono, że ustawa o ochronie praw lokatorów faktycznie realizuje cel, dla jakiego została uchwalona. Ustawodawca wprowadził silne i skuteczne mechanizmy chroniące lokatorów. Jednakże, wprowadzone uregulowania nadmiernie chroniące lokatora naruszają dyrektywy składające się na treść konstytucyjnej zasady proporcjonalności. Autorka w toku pracy prezentuje kompromisowe rozwiązania, które umożliwią pogodzenie interesów obydwu stron, bez nadmiernej ingerencji w sferę praw właściciela. W jej ocenie ustawa o ochronie praw lokatorów powinna zostać poddana znacznym modyfikacjom zmierzającym do zrównoważenia interesów właścicieli i lokatorów. |
abstrakt w j. angielskim: | The aim of the Master’s dissertation entitled “Constitutionality of limitations of owner’s rights supporting the protection of tenants’ rights” is an effort of evidencing a thesis stating that on the basis of the applicable regulations, the protection of tenants’ rights is excessively broadly determined, which causes it to violate the idea of ownership rights, while its scope arises doubts in the context of the constitutional principle of proportionality. The structure of the dissertation is as follows: the first chapter presents the factors which had an impact on developing the idea of tenants’ rights, as well as a brief characteristic of the key sources of tenants’ law from in the Interwar period and the period of People’s Poland. Furthermore, the chapter describes the situation relating to the housing situation in non-communist countries. The third chapter, in order to present the full idea of the subject, refers to the general regulations relating to lease. The further part of the chapter features and in-depth comparative analysis of the legal position of the tenant and the landlord on the basis of the applicable provisions. It also includes an analysis of the Tenants’ Rights Act, the housing resources of the commune as well as amendment of the Civil Code in terms of the directives composing the content of the constitutional principle of proportionality, with consideration of the Constitutional Tribunal decision. In the course of the study it was claimed that the Tenants’ Protection Act actually executes the aim for which it was adopted. The legislator introduced strong and efficient mechanisms protecting tenants. Nevertheless, the introduced regulations which provide excessive protection to the tenants violates the directive composing the content of the constitutional principle of proportionality. In the course of the work, the author presents compromising solutions which would enable reconciliation of the interests of both parties, without excessive interference with the owner’s rights. In the author’s opinion, the Tenants’ Protection Act should be subjected to significant amendments aiming at balancing the interests of owners and tenants. |
