Praca poświęcona jest problematyce klauzul niedozwolonych występujących w obrocie we wzorcach umów rachunku bankowego. W pierwszej kolejności analizie zostały poddane akty prawa europejskiego, które zdeterminowały kształt przedstawionej następnie polskiej regulacji dotyczącej wzorców umownych oraz klauzul niedozwolonych. Następnie omówione zostały przepisy dotyczące umowy rachunku bankowego, kart płatniczych i bankowości elektronicznej. Analiza przepisów Kodeksu Postępowania Cywilnego dotyczących postępowania o uznanie postanowienia wzorca umowy za niedozwolone oraz przedstawienie problemu rozszerzonej prawomocności wyroku Sądu Ochrony Konkurencji i Konsumenta jest wprowadzeniem do tematu Rejestru Klauzul Niedozwolonych. Do rejestru tego zostały wpisane klauzule, które zostały przeanalizowane w dalszej części pracy. Ze względu na treść postanowień, zostały one zaklasyfikowane do kilku grup wraz z szerokim omówieniem powodów ich wpisu do Rejestru Klauzul Niedozwolonych opartym na dorobku orzecznictwa i doktryny. Praca zakończona jest wypunktowaniem wad obecnego prawnego uregulowania omawianego tematu oraz propozycją jego zmian.

Present thesis concerns the topic of abusive contract terms in standard bank account contracts. Firstly, subject of analysis were European laws, which determined the shape of further analyzed Polish legislation on standard contracts and abusive contract terms. Provisions on the bank account contract, payment cards and electronic banking were discussed afterwards. Analysis of the Code of Civil Procedure in the context of the procedure for recognition standard contract term as abusive and the problem of enlarged legal validity of judgment of the Court of Competition and Consumer Protection is an introduction to the topic of the Register of Prohibited Clauses. This register consists of abusive clauses, which were analyzed in the rest of the thesis. Due to the content of this abusive contract terms , they were classified into several groups with a broad overview of the reasons for their entry into the Register of Prohibited Clauses based on jurisprudence and doctrine. The work is finished with the description of drawbacks of the current legal regulation on the presented topic and proposed amendments to this legislation.
