Praca zawiera analizę instytucji odmowy wszczęcia postępowania administracyjnego oraz konsekwencje wprowadzenia tej instytucji do kodeksu postępowania administracyjnego, w szczególności kontroli interesu prawnego na etapie wstępnym postępowania. Analizie poddane zostały przesłanki podmiotowa i przedmiotowa odmowy wszczęcia postępowania jak również konsekwencje zaskarżenia postanowienia o odmowie wszczęcia postępowania. W pracy zawarto także opis konsekwencji dodania tej instytucji do Kodeksu dla określenia momentu wszczęcia postępowania administracyjnego.

The paper contains an analysis of the institution's refusal to initiate administrative proceedings and the consequences of the introduction of the institution to the Code of Administrative Procedure, in particular the control of the legal interest at the initial stage of the proceedings. The analysis of the conditions Subjective and objective refusal to initiate proceedings as well as the consequences of challenging the decision not to initiate proceedings. The paper also contains a description of the consequences of this institution added to the Code to determine the initiation of administrative proceedings.
