Przedmiotem opracowania jest przegląd uregulowań kodeksu cywilnego, dotyczących okoliczności wyłączających bezprawność naruszenia dóbr osobistych, poprzez wykazanie wszystkich dopuszczonych przez prawo, jak również orzecznictwo okoliczności pozwalają-cych na legalne wkroczenie w sferę prawnie chronioną innego podmiotu i łącznie z nim zwią-zaną. Analizie zostały poddane wszystkie przesłanki determinujące zgodne z prawem naru-szenie dóbr prawnie chronionych, uzasadnione w świetle obowiązującego stanu prawnego. Sąd Najwyższy mając na względzie znaczenie jego orzecznictwa w polskim systemie prawa orzekł, iż nie jest zachowaniem bezprawnym działanie podjęte w zgodzie z prawem, chociażby naruszało chronione prawnie dobra osobiste enumeratywnie wymienione w art. 23 k.c., jak również działania pojęte w ramach wykonywania własnego prawa podmiotowego. Do oko-liczności tych Sąd Najwyższy zaliczył również zgodę uprawnionego, która uchyla bezpraw-ność – w takim zakresie, w jakim poszkodowany może dysponować naruszonymi dobrami, co w konsekwencji może prowadzić do wyłączenia odpowiedzialności sprawcy tego naruszenia oraz działanie w ramach społecznie uzasadnionego interesu, lecz o ile w przypadku pozosta-łych okoliczności nie ma większych sporów co do ich zasadności, o tyle na tym gruncie orzecznictwo i doktryna nie są do końca jednomyślne. Całości opracowania towarzyszy kom-pleksowe spojrzenie na poruszaną tematykę, dostrzegając szerzej nieanalizowaną dotychczas sferę dóbr osobistych, uwzględniając praktyczny aspekt ww. zagadnienia.

The object of the study is to review the rules of the Civil Code concerning the circum-stances excluding illegality of violations of personal rights , by showing all authorized by the law, as well as the case law of the circumstances that allow the legitimate entrance into the realm of legally protected by another entity and together with him related .The analysis has been subjected to all the conditions determining the lawfulness of a breach of a legally pro-tected good , justified in the light of the applicable state law. The Supreme Court in view of the importance of its case-law in the Polish legal system has ruled that it is not unlawful con-duct action taken in accordance with the law , even violate the legally protected personal rights enumerated in art . 23 of the Civil Code , as well as measures conceived in the exercise of their individual right . These circumstances, the Supreme Court also scored agreement of authorized, which repeals illegality - the extent to which the victim may have infringed goods, which consequently may lead to the exclusion of liability perpetrator of the infringement and the action of the socially legitimate interest, but as far as in the case of other circumstances there is little dispute as to their validity, with so much on the basis of case-law and doctrine of the two are not entirely unanimous.
