Tematem niniejszej pracy jest przybliżenie i podsumowanie dyskusji na temat harmonizacji prawa prywatnego w ramach Unii Europejskiej oraz próba odpowiedzi na pytanie jaka będzie przyszłość harmonizacji. Z uwagi na objętość działu prawa jakim jest prawo prywatne zakres pracy ograniczony został do prawa zobowiązań. W pierwszym rozdziale została przedstawiona historia dotychczasowych prac nad harmonizacją. W drugim natomiast rozważone zostały podstawowe problemy prawne wiążące się z wprowadzeniem wspólnych europejskich przepisów prawa prywatnego, takie jak podstawy prawne i kompetencja Unii Europejskiej do dokonania harmonizacji, forma prawna przyszłej harmonizacji oraz jej zakres merytoryczny. Kolejny rozdział szczegółowo przedstawia dyskusję nad harmonizacją z podziałem na argumenty przeciwników i zwolenników harmonizacji. Rozdział czwarty poświęcony jest projektowi rozporządzenia w sprawie wspólnych europejskich przepisów dotyczących sprzedaży oraz przyszłości harmonizacji. Zakończenie jest podsumowaniem całej pracy i przedstawia własne stanowisko autorki na temat przyszłości harmonizacji prawa prywatnego.

Subject of the thesis is the approximation and summary of the discussion on harmonization of the private law within the framework of the European Union and also an attempt to answer the question what will be the future of the harmonization. Due to the volume of the private law branch, scope of the thesis is limited to the contract law. The first chapter is the description of history of the harmonization works done so far. The second chapter is the consideration of the main legal problems connected with introduction of the common European private law provisions, such as the legal basis and competence of the European Union to perform the harmonization, the legal form of the future harmonization and its’ substantial scope. The next chapter is the detailed presentation of the discussion on harmonization with division of the arguments of both supporters and opponents of the harmonization. The fourth chapter is devoted both to the project of the decree on the common European sales law and to the description of the future of the harmonization. The Conclusion is the summary of the whole thesis and the presentation of the author’s viewpoint on the future of the harmonization.
