According to art. 1015 § 1 of civil code, the heir can make a statement of accepting or rejecting an inheritance within six months from the moment of learning about his right to inherit. The article deals with the consequences of making such a statement before the start of this period. The remarks refer to the judgment of the Supreme Court of October 19, 2018, III CZP 36/18, in which it was assumed that such a premature statement has no legal force. The article presents further complications that may arise from this assumption. It also raises the question of introducing into the Polish legal system a solution that would allow to reject inheritance before the start of the statutory six-month period. As it was attempted to justify, such a solution has its advantages and disadvantages. Nevertheless it may be a proposal worth considering in the course of future discussions on changes in the inheritance law.
