Dopuszczalność korzystania z dowodów uzyskanych w sposób bezprawny w postępowaniu cywilnym
The article is concerned with the issue of admissibility of unlawfully obtained evidence in civil proceeding. It starts with a review of opinions previously presented, both in publishing and in jurisdiction, that are corresponding to the topics discussed. The authors, citing various arguments, try to show that the use of evidence obtained by breaching the law is acceptable in civil proceedings. They argue against previously presented ideas and state their own, distinct, views on the issue. According to them, there is no basis for refusing to take into account the evidence unlawfully obtained, especially when we consider the fact that the legislature has chosen not to settle this matter. The way of obtaining evidence and the feasibility of that evidence in the process should be clearly separated. In the current state of the law, there is no normative basis for an opposite interpretation. The article also underscores the constitutional dimension of this conflict, as it lies at the root of the controversy related to the discussed issues.
