Przedmiotem artykułu jest analiza art. 440 k.p.k. na płaszczyźnie modelowej oraz w perspektywie konkretnych przypadków jego zastosowania. Przepis ten stanowi podstawę przełamania kierunku środka zaskarżenia oraz orzekania niezależnie od granic zaskarżenia i podniesionych zarzutów, jeżeli utrzymanie w mocy powodowałoby rażącą niesprawiedliwość orzeczenia. Autor wskazuje, iż z perspektywy modelowej regulacja ta nadaje postępowaniu odwoławczemu rewizyjny charakter. Teza ta uzasadniona jest przede wszystkim szerokim zakresem klauzuli generalnej oraz obowiązkiem zastosowania art. 440 k.p.k. przez sąd odwoławczy. Autor stawia również tezę, iż obecne brzmienie art. 440 k.p.k. nie koresponduje ze zmianami dokonanymi na gruncie przepisów normujących postępowanie odwoławcze.

The subject of that article is the analysis of the art. 440 of the Code of Criminal Procedure (referred to as k.p.k.). The analysis is made on two planes both the procedural model and the enforcement of that provision. For the court it is a basis to break the direction of the appeal and to adjudge regardless of the scope of the appeal and regardless of raised objections. It might occur, if upholding a ruling would be manifestly unjust. The author points, that from a procedural model perspective, that provision accords to the appeal proceeding revisory character. What justifies that thesis, is wide scope of general clause and the obligation to enforce the article 440 of k.p.k. in the appeal proceeding. The author puts forward the thesis, that current wording of the article 440 k.p.k. does not correspond with changes in the provisions which regulate appeal proceeding.
