Press reports concerning a trial in view of the right to freedom of expression (article 10 of the ECHR) in judicial decisions of the ECtHR

Artykuł porusza problematykę interpretacji prawa do swobody wypowiedzi (art. 10 Europejskiej Konwencji Praw Człowieka) w orzecznictwie Europejskiego Trybunału Praw Człowieka. EKPC jest częścią polskiego porządku prawnego i tylko znajomość orzecznictwa ETPC pozwala na zrozumienie treści tego prawa. W artykule poruszono kwestie związane z interpretowanym pojęciem, a także możliwymi ograniczeniami prawa do swobody wypowiedzi wynikającymi z art. 10 ust. 2 EKPC. W dalszej części przytoczono główne tezy najistotniejszych orzeczeń ETPC odnoszących się do prawa do swobody wypowiedzi w kontekście procesu karnego i cywilnego w ogólności, a ponadto dotyczących zarówno oskarżonego, jak i pokrzywdzonego. W podsumowaniu wskazano na rolę prasy we współczesnym społeczeństwie i znaczenie EKPC dla ochrony jej wolności.

The article shows the problems concerning interpretation of the right to freedom of expression (Article 10 of the ECHR) in judicial decisions of the ECtHR. The ECHR is part of the Polish legal order and only the knowledge of judicial decisions of the ECtHR enables one to understand the content of this right. The article raises the matters regarding the interpreted concept as well as possible limitations of the right to freedom of expression under Article 10.2 of the ECHR. Further part of the article includes the main arguments in judicial decisions of the ECtHR concerning the right to freedom of expression in terms of criminal proceedings and civil litigation and, moreover, referring to the defendant as well as the injured party. The summary shows the role of the press in contemporary society and the meaning of the ECHR for protection of this freedom.
