Praca przedstawia problematykę „aktualności” w procesie stosowania prawa administracyjnego. Normy prawa administracyjnego posiadają bowiem charakter bezwzględnie obowiązujący i co do zasady muszą być stosowane według dnia, w którym akt administracyjny zostaje wydany. Ważne jest tu także uwzględnienie tylko bieżącego stanu faktycznego w danej sprawie. Ta, pozornie prosta do spełnienia dyrektywa - zasada aktualności - przysparza wielu problemów, które są przedmiotem rozważań w pracy. Z racji nadania aktualności w ramach stosowania prawa administracyjnego rangi normy-zasady, praca porusza także tematykę zasad prawnych oraz ukazuje wybór zasad prawa i postępowania administracyjnego z perspektywy aktualności. Najpierw przedstawiony został aspekt teoretyczny z punkt widzenia norm prawa materialnego, będący podstawą wyodrębnienia zasady aktualności w ujęciu materialnoprawnym (sensu stricto i largo). Następnie omówiona została problematyka postępowania administracyjnego, które jest instrumentem realizowania norm materialnych. Przy tym, procedura w wielu aspektach ogranicza meritum zasady aktualności, co stało się przedmiotem wnikliwych rozważań i asumptem do wyodrębnienia zasady aktualności w ujęciu proceduralnym. Praca omawia także określone instytucje procedury administracyjnej z punktu widzenia zasady aktualności.

The paper presents the problems connected with the validity in the process of applying administrative law. It should be noted that administrative law standards are of a peremptory nature and, in principle, have to be applied as per the day on which an administrative act is issued. Another important thing here is to take account only of the current actual state in a given matter. This, apparently easy to observe, directive – the principle of validity – causes many problems, which are the topic of the paper. Because of giving the validity the meaning of a standard and principle within applying of administrative law, the paper also raises the subject of legal principles as well as it depicts a selection of principles of law and administrative proceedings from the view of the validity. At first, the paper presents the theoretical aspect from the view of substantive law standards, which aspect is the basis for isolating the principle of validity in a substantive law perspective (sensu stricto and largo). Then, the paper discusses the problems connected with administrative proceedings, which are an instrument of implementation of substantive standards. Moreover, in many aspects a procedure limits the essence of the principle of validity and this phenomenon became the subject of insightful dissertation and also it gave rise to the isolation of the principle of validity in a procedural perspective. The paper also discusses specified institutions of administrative procedure from the viewpoint of the principle of validity.
