Przedmiotem opracowania jest analiza zmian ustawodawczych dotyczących prawa do zasiłku macierzyńskiego, ze szczególnym uwzględnieniem nowelizacji kodeksu pracy oraz ustawy o świadczeniach pieniężnych z tytułu choroby i macierzyństwa, które weszły w życie z początkiem 2016 r. Autor zwraca uwagę na stopniowe zwiększanie zakresu uprawnień związanych z rodzicielstwem oraz ich uelastycznienie. Krytycznie ocenia istniejący stan prawny oraz zwraca uwagę na celowość nowego podejścia do ochrony rodzicielstwa, zarówno poprzez sformułowanie nowych założeń ochrony rodzicielstwa jak i uproszczenia obowiązujących przepisów.

The elaboration is dedicated to the analysis of the legislative changes concerning the right to the maternity benefit, with particular attention paid to the amendments to the Labour Code and the Law on Pecuniary Benefits in Case of Sickness and Maternity, that took effect at the beginning of 2016. Author emphasizes that the scope of rights connected to parenthood has been gradualny extended. At the same time, these regulations became much more flexible than before. He critically evaluates the current legal framework and suggests the new attitude towards the protection of parenthood. The changes could refer both to the new basis for parenthood protection and simplifying the existing regulations.
