Zasadą jest, że strony postępowania jurysdykcyjnego ustalane są w oparciu o regulację ogólną zawartą w art. 28 k.p.a. Ustawodawca wprowadził jednak w art. 28 ust. 2 pr.bud. regulację szczególną stanowiącą podstawę określania kręgu podmiotów mających przymiot strony w postępowaniach w sprawie pozwolenia budowlanego. W niniejszym opracowaniu wskazano zasady określania kręgu stron postępowania w sprawie o zatwierdzenie projektu budowlanego, uwzględniając zarówno aspekt legitymacji do udziału w tym postępowaniu, jak i zdolność administracyjnoprawną warunkującą udział w przedmiotowym postępowaniu. Zwrócono również uwagę na niedoskonałość rozwiązań normatywnych w tym zakresie postulując ich zmianę.
Abstract in English
The rule is that the parties to the jurisdiction proceedings are determined on the basis of a general regulation in article 28 of the Code of Administrative Proceedings. The legislator, however, in article 28. 2 of the Construction Law, introduced a special regulation being the basis for determining a group of entities having an attribute of a party to the proceedings related to the building permit. The present study presents rules of determining a group of parties to the proceedings concerning the approval of the building design, considering both an aspect of legitimacy to participate in the proceedings as well as the administrative law capacity conditioning the participation in the said proceedings. Attention was also paid to the imperfection of normative solutions in this respect, postulating their change.
