Przesłanki powództwa o ustalenie prawa lub stosunku prawnego zostały określone w art. 189 k.p.c. Skuteczność tego powództwa zależy w pierwszej kolejności od wykazania legitymacji powoda do dochodzenia takiego żądania, interesu prawnego w uzyskaniu orzeczenia ustalającego określone prawo prawo lub elementy treści stosunku prawnego. w dalszej kolejności o uwzględnieniu powództwa decyduje to, czy powód wykaże prawdziwość swoich twierdzeń o treści spornego prawa lub stosunku prawnego. W opracowaniu wskazano, kto może skutecznie wystąpić z powództwem o ustalenie prawa lub stosunku prawnego, przedstawiono charakter tego powództwa, sposób rozumienia pojęcia interes prawny w ustaleniu prawa lub stosunku prawnego, sytuacje usprawiedliwiające przyjęcie, że ta przesłanka powództwa została spełniona. Actions for performance, actions for judicial modification of legal relationships, and actions for declaratory judgments are the three types of procedures to grant relief requested by plaintiffs in civil actions. Art. 189 of the Code of Civil Procedure defines the premises for actions for a declaration of rights or legal relations. The effectiveness of the actions concerned depends primarily on proving the plaintiffs’ capacity to pursue a particular claim, on their legal interest in obtaining a judgment that declares a particular right, or on particular aspects of the legal relationship concerned. Another condition to allow a particular action involves the plaintiffs’ proving the truthfulness of their statements as regards the content of the disputable rights or legal relationships. The study shows who may effectively bring actions for a declaration of rights or legal relations, describes the nature of such actions, provides the interpretation of the ‘legal interest’ while declaring a right or a legal relation, and defines the circumstances that justify the assumption that the relevant premises for a particular action have been satisfied. In addition, the paper contains numerous examples of cases where a party to a contract may seek legal protection as regards its contractor, while applying the action concerned.
